TourCue Terms of Service

These Terms of Service ("Terms") govern your use of TourCue, a software platform operated by Ascent Information Management ("TourCue," "we," "us," or "our"), located in Texas, United States. By creating an account or using TourCue, you agree to these Terms.
1. What TourCue Is
TourCue is a software platform that helps organizers create, publish, and manage driving tour routes, cue cards, participant registration, and event-day navigation. TourCue provides tools — it does not organize, operate, insure, or supervise any event.
TourCue is not:
- The tour organizer or event operator
- A safety authority or road-conditions authority
- An insurer or permitting authority
- A legal advisor or waiver provider of record
- Responsible for the safety, legality, or accuracy of any route or event
The organizer is solely responsible for planning, operating, and ensuring the safety of their event.
2. Accounts
Eligibility. You must be at least 18 years old and capable of entering a binding contract to create an organizer account.
Account security. You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately at info@tourcue.com if you believe your account has been compromised.
Accurate information. You agree to provide accurate, current information when creating your account. TourCue may suspend or terminate accounts with false or misleading information.
One account per person. You may create multiple organizations under one account, but accounts may not be shared or transferred.
3. Organizer Responsibilities
By using TourCue as an organizer, you agree that you are solely responsible for:
- Obtaining all required permits, licenses, and government approvals for your event
- Securing appropriate insurance coverage for your event and participants
- Planning a safe route and ensuring it complies with applicable traffic laws
- Communicating safety information to participants
- Managing participant eligibility, waivers, and informed consent
- Deciding whether an event should proceed given real-world conditions (weather, road closures, hazards, etc.)
- Complying with all applicable local, state, and federal laws
- Collecting and managing any required participant data in compliance with applicable privacy laws
TourCue provides software tools. Organizers are the operators of their events.
4. Acceptable Use
You agree not to use TourCue to:
- Organize events that are illegal, dangerous, or intended to harm participants
- Violate any applicable law or regulation
- Upload content that is defamatory, obscene, or infringes intellectual property rights
- Attempt to access another user's account or data
- Interfere with or disrupt TourCue's infrastructure or services
- Scrape, copy, or resell TourCue's software or data without written permission
We reserve the right to suspend or terminate accounts that violate these terms.
5. Billing and Fees
Organizer billing. TourCue charges organizers for publishing tours at the following rates:

Per-event fees are charged at the time of tour publication and are non-refundable once a tour is published.
Annual subscriptions renew automatically each year. You may cancel your annual subscription at any time; your access continues through the end of the paid billing period.
Participant platform fee. On Tour and Grand Tour tiers with participant registration enabled, TourCue collects a $5.00 platform fee per confirmed paid registration via Stripe Connect. This fee is deducted automatically at the time of payment. Organizers receive the ticket price minus the $5.00 platform fee and applicable Stripe processing fees.
Payment processing. All payments are processed by Stripe. By using paid features, you agree to Stripe's Terms of Service.
Taxes. You are responsible for any applicable taxes on your event ticket sales. TourCue collects and remits platform fees only and does not provide tax advice.
6. Participant Payments and Stripe Connect
Organizers who collect participant payments must connect a Stripe account ("Stripe Connect"). By connecting a Stripe account, you agree to Stripe's Connected Account Agreement. TourCue acts as the platform; you are the connected account. Payouts are subject to Stripe's standard payout schedule.
Organization-level connection. Stripe is connected at the organization level, not per tour. You acknowledge and agree that each organization you create in TourCue (as described in Section 2) represents a single entity with a single designated bank or payout account, and that one connected Stripe account serves all tours within that organization. If you require funds to settle to separate bank accounts, or you operate separate legal entities, you must establish a separate organization for each and connect a distinct Stripe account to it. TourCue may rely on this assumption. Although TourCue may provide reporting that attributes registrations, orders, and payments by organization and tour, you remain solely responsible for your own external accounting, tax treatment, legal allocation, bank reconciliation, and segregation of funds among tours you choose to group under a single organization. The detailed terms of this arrangement are set out in the Platform Fee Agreement.
Organizers are solely responsible for:
- Issuing refunds to participants (TourCue does not process refunds automatically)
- Honoring their published refund policy
- Responding to payment disputes and chargebacks
TourCue is not liable for chargebacks or payment disputes on participant payments.
7. Intellectual Property
TourCue's IP. The TourCue platform, including its software, design, and branding, is owned by Ascent Information Management and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute TourCue's software or materials without written permission.
Your content. You retain ownership of the routes, cue cards, and other content you create in TourCue. By using TourCue, you grant us a limited license to store, display, and transmit your content as necessary to provide the service.
Feedback. If you submit feedback or suggestions to TourCue, we may use them without obligation to you.
8. Privacy
Your use of TourCue is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using TourCue, you consent to the data practices described in the Privacy Policy.
9. Disclaimer of Warranties
TourCue is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:
- The service will be uninterrupted, error-free, or secure
- Routes, cue cards, or navigation information will be accurate, complete, or safe
- The service will meet your specific requirements
TourCue does not guarantee the safety, legality, or accuracy of any route, event, or navigation instruction. Drivers are responsible for obeying traffic laws, road signs, and actual road conditions at all times.
10. Limitation of Liability
To the maximum extent permitted by applicable law, TourCue's total liability to you for any claim arising from or related to these Terms or the service shall not exceed the fees you paid to TourCue in the 12 months preceding the claim.
TourCue is not liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or goodwill
- Injuries, accidents, or property damage arising from events using TourCue
- Decisions made by organizers or participants based on TourCue's navigation tools
- Interruptions, outages, or errors in the service
Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless TourCue, Ascent Information Management, and their officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
- Your use of TourCue
- Your event's operation, safety, or compliance
- Your violation of these Terms
- Your violation of any third party's rights
12. Termination
By you. You may close your account at any time by contacting us at info@tourcue.com. Closing your account does not entitle you to a refund of any paid fees.
By us. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice. We may terminate accounts immediately for serious violations without notice.
Effect of termination. Upon termination, your right to use TourCue ceases. We may retain your data as described in our Privacy Policy and as required by law.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
Informal resolution. Before filing any legal claim, you agree to contact us at info@tourcue.com and give us 30 days to attempt to resolve the dispute informally.
Binding arbitration. If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in Texas. You waive your right to a jury trial and to participate in a class action.
Exceptions. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction for matters involving intellectual property or imminent harm.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by a notice within the TourCue portal at least 14 days before the changes take effect. Your continued use of TourCue after the effective date constitutes acceptance of the updated Terms.
