TourCue Platform Fee Agreement

This Platform Fee Agreement ("Agreement") applies to organizers who use TourCue to collect participant payments on Tour and Grand Tour tiers. It supplements the TourCue Terms of Service.
1. Overview
When you collect participant registration fees through TourCue, TourCue automatically deducts a $5.00 platform fee per confirmed paid registration via Stripe Connect. This Agreement explains how that fee works, your obligations as a connected organizer, and the relationship between TourCue, you, and your participants.
2. How the Platform Fee Works
Automatic deduction. The $5.00 platform fee is deducted at the moment a participant's payment is confirmed — before funds are transferred to your Stripe account. You never receive the $5.00 and pay TourCue separately; it is retained by TourCue automatically.
What you receive. For each paid registration, you receive:
Ticket price − $5.00 platform fee − Stripe processing fees (2.9% + $0.30)
Example. A $50.00 ticket:
- Platform fee: −$5.00
- Stripe processing: −$1.75 (2.9% × $50 + $0.30)
- You receive: $43.25
Free registrations. The $5.00 platform fee applies only to paid registrations (where total_amount_cents > 0). Free registrations are not subject to the platform fee.
No fee for Cruise or Car Club tiers. The platform fee only applies to Tour and Grand Tour tiers. Cruise and Car Club tiers do not support participant payment collection and are not subject to this Agreement.
3. Stripe Connect
Requirement. To collect participant payments, you must connect a Stripe account to TourCue. TourCue uses Stripe Connect (Express accounts) to route participant payments to you.
Organization-level account. The Stripe connection is established and maintained at the organization level, not at the level of any individual tour. By connecting Stripe, you represent and acknowledge that each organization you create in TourCue corresponds to a single legal or operating entity holding a single designated bank or payout account, and you authorize TourCue to route the registration proceeds of every tour within that organization to the one Stripe connected account associated with it. You connect Stripe once per organization; all of that organization's current and future tours share the same connected account and its payout arrangements. If you operate more than one distinct entity, or require funds to settle to separate bank accounts, you must create a separate TourCue organization for each and connect a distinct Stripe account to each. TourCue is entitled to rely on this one-organization-to-one-entity correspondence. Although TourCue may provide reporting tools that attribute registrations, orders, and payments by organization and tour, you remain solely responsible for your own external accounting, tax treatment, legal allocation, bank reconciliation, and segregation of funds for tours that you elect to group within a single organization.
Stripe's terms. By connecting a Stripe account, you agree to the Stripe Connected Account Agreement. TourCue is the platform; you are the connected account. Stripe's payout schedule applies to your account — TourCue does not control or guarantee payout timing.
KYC verification. Stripe requires identity verification (Know Your Customer) before payouts are enabled. TourCue initiates this process via Stripe's hosted onboarding. You must complete Stripe's verification before you can receive payouts.
Account status. If your Stripe account is suspended, terminated, or restricted, your ability to collect participant payments through TourCue is suspended for the duration. TourCue is not responsible for Stripe account suspensions. Navigation features (routing, cue cards, QR join) remain available regardless of Stripe account status.
4. Your Responsibilities
Refunds. You are solely responsible for issuing refunds to participants. TourCue does not automatically refund payments. Refunds must be processed through your Stripe dashboard or as directed by Stripe.
Refund policy. Your published refund policy (set in TourCue's registration setup) is binding. Communicate your refund policy clearly to participants before they register.
Chargebacks and disputes. You are responsible for responding to chargebacks on your event's participant payments. TourCue provides registration evidence records (waiver acknowledgment timestamps, IP addresses, registration details) to assist with dispute responses, but TourCue is not liable for chargeback outcomes.
Taxes. You are responsible for collecting and remitting any applicable sales tax, GST, or other taxes on your ticket sales. TourCue is not a tax advisor and does not provide tax guidance. The platform fee charged to TourCue may be subject to separate taxation of TourCue's income — this is TourCue's obligation, not yours.
Compliance. You are responsible for ensuring your event registration complies with applicable laws, including consumer protection laws in your jurisdiction.
5. Registration Data
Participant data collected through TourCue's registration forms (names, emails, payment information) belongs to you and your participants. TourCue stores this data on your behalf as described in the Privacy Policy.
You may not use participant data for purposes unrelated to your event without participant consent.
6. Platform Fee Changes
TourCue may update the platform fee with at least 30 days' notice. Changes apply to registrations processed after the effective date, not retroactively to existing confirmed registrations.
7. Termination
If you stop using TourCue's paid registration features or if your account is terminated, the platform fee ceases to apply from that point forward. No refund of platform fees already collected is owed.
8. Relationship of Parties
TourCue and you are independent contractors. Nothing in this Agreement creates a partnership, joint venture, agency, employment, or franchise relationship.
TourCue is not a party to the transaction between you and your participants. TourCue provides the payment infrastructure; you are the seller of the event tickets.
